Our commitment to copyright
ThePandaHug respects the intellectual property rights of others and expects our customers to do the same. In line with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, we respond promptly to valid notices of copyright infringement, and we may end the accounts of repeat infringers.
Most of what we sell is our own ready-made designs. Some products let customers add their own text or upload an image to personalize an item. We do not review every customer-supplied item in advance, so we cannot promise that none of them infringes someone's rights. When we receive a valid notice, we act on it.
How to send a takedown notice
If you believe that material on this Site, or an item made from a customer's upload, infringes your copyright, email a written notice to support@vivdrop.com with the subject line "DMCA Takedown Notice". Under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Your physical or electronic signature, or that of a person authorized to act for the copyright owner.
- Identification of the copyrighted work you say has been infringed. If one notice covers several works, a representative list is fine.
- Identification of the infringing material and enough information for us to find it, for example the page address or an order number.
- Your name, address, telephone number and email address.
- A statement that you have a good faith belief that the use of the material in the way you describe is not authorized by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.
We may ask for more information before we act. Incomplete notices may not be acted on.
What happens after we receive a valid notice
When we receive a valid, complete notice, we will promptly:
- Remove or disable access to the material identified in the notice.
- Tell the customer who submitted it, if it came from a customer.
- Keep a record of the notice.
If an order containing the material has already shipped, we cannot undo the shipment. We will stop making that item and may take action on the customer's account.
Counter-notice
If you believe the material was removed by mistake or misidentification, or that you are authorized to use it, you may send a counter-notice to support@vivdrop.com. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed by mistake or misidentification.
- Your name, address and telephone number, a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if you are outside the United States, any judicial district where we may be found), and a statement that you will accept service of process from the person who sent the original notice.
When we receive a valid counter-notice, we forward it to the person who sent the original notice. We may restore the material in 10–14 business days unless that person tells us they have filed a court action.
Repeat infringers
We may end the account of anyone who repeatedly submits infringing content. We may treat a user as a repeat infringer if we receive two or more valid DMCA complaints about their content.
Misrepresentation
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including attorney's fees. Please make sure your notice is accurate.
Trademark concerns
This policy covers copyright. If you have a trademark concern, email support@vivdrop.com with a description of the mark, evidence that you own it and the content you believe infringes it.
