Agreeing to these terms

By using this website (thepandahug.com, the "Site") or placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site or place an order. The Site is run by KZD LLC, which operates ThePandaHug ("we", "us", "our"). These Terms apply to all visitors, customers and others who use the Site.

By placing an order you confirm that you are at least 18 years old, or that you are a parent or legal guardian supervising a minor who is using the Site.

Orders, prices and payment

  • Orders: placing an order is an offer to buy. We may decline or cancel any order, for example because of a pricing error, suspected fraud or because we are unable to fulfill it. If we cancel an order you have already paid for, we will refund it.
  • Prices: all prices are in US dollars and do not include shipping or taxes unless we say so. The Site may show a sitewide sale as a crossed-out regular price beside the sale price. The price you pay is the price shown at checkout. Prices and sales can change at any time, but a change does not affect an order we have already accepted.
  • Payment: we take card payments through Stripe Checkout, including Apple Pay and Google Pay where your browser supports them. We do not store your card details. By paying, you also agree to Stripe's terms (stripe.com/legal).
  • Taxes: you are responsible for any applicable taxes. We collect sales tax on Illinois orders where required by law, and it is calculated at checkout.
  • Chargebacks and disputes: filing a fraudulent chargeback for an order we fulfilled is fraud. We may pursue recovery of the funds and report it to the relevant authorities. If you have a problem with an order, please contact us first so we can fix it.

Personalization and your content

Many designs can be personalized with names, dates, text, choices from a list and, on some designs, an uploaded image ("your content").

  • Accuracy: we use your content as you enter it, including spelling, spacing and punctuation. You are responsible for checking it before you pay.
  • Rights: you confirm that you own your content or have all the rights, licenses and permissions we need to reproduce it on your order, and that it does not infringe anyone's copyright, trademark, privacy, publicity or other rights.
  • Prohibited content: your content must not be defamatory, obscene, sexually explicit involving minors, threatening or harassing, or promote or glorify illegal activity, violence, terrorism, or hate against any group based on race, ethnicity, religion, gender, sexual orientation, disability or national origin.
  • Our right to refuse: we may decline to make any item whose content we consider inappropriate, infringing or in breach of these Terms. If we decline an order before making it, we will refund it in full.
  • Indemnity: you agree to defend, indemnify and hold harmless KZD LLC (ThePandaHug) and its owners, employees and agents from any claim, liability, cost or expense (including reasonable attorney's fees) arising from your content or your breach of these Terms.

Making and shipping your order

  • Made to order: items are made after you order. Processing takes 1–2 business days before an order ships. Processing times are estimates, not guarantees.
  • Shipping: we ship to addresses in the United States. Rates and details are on the Shipping & delivery page. Delivery times come from the carrier, start when your order leaves us and are not guaranteed. We are not responsible for carrier delays, weather or other events outside our control.
  • Tracking: we email tracking information when your order ships. If a package is lost or damaged in transit, the remedies are on the Returns & exchanges page.
  • Address accuracy: you are responsible for entering a complete and accurate shipping address. We do not remake or refund orders sent to an incorrect address that you entered.

Returns, refunds and remakes

Every item is made to order, and most are personalized for you, so we generally do not accept returns or exchanges for change of mind or a wrong size ordered. We will remake or refund an item that arrives with a misprint, a defect or damage, or that we got wrong, when you contact us within 7 days as described on Returns & exchanges. That page forms part of these Terms.

Colors and appearance

DTF printing is a high-quality process, but we cannot guarantee that colors will exactly match your screen. Reasons include:

  • Differences in screen calibration between your device and our production.
  • Natural variation between fabric dye lots and between garment-dyed pieces.
  • Heather fabrics, where used, show their texture through the print.
  • Dark garments can change how light colors in a print look.

By ordering, you acknowledge these limits and agree that color variation alone is not a reason for a refund.

Our designs and content

The designs, artwork, photos, text and other content on the Site belong to KZD LLC (ThePandaHug) or its licensors and are protected by copyright and other laws. Buying a product gives you the product, not the right to copy our designs or to use them to make or sell other products.

We respect intellectual property rights. If you believe something on the Site infringes your copyright, please read our Copyright & DMCA policy.

Accounts

  • You are responsible for keeping your sign-in details secure and for all activity on your account.
  • Tell us right away if you think someone has used your account without your permission.
  • We may close accounts that break these Terms.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KZD LLC (THEPANDAHUG) AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR ANY PURCHASE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE ORDER THAT GAVE RISE TO THE CLAIM.

Disclaimer of warranties

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES.

Governing law and disputes

These Terms are governed by the laws of the United States and of the state in which KZD LLC operates, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or any purchase should first be raised with us so we can try to resolve it informally. If it is not resolved within 30 days, it will be submitted to binding arbitration under the rules of the American Arbitration Association.

You agree to waive any right to take part in a class action against KZD LLC (ThePandaHug).

Changes to these terms

We may update these Terms at any time. The "last updated" date on this page shows the latest version. Using the Site after a change means you accept the new Terms.
